These terms apply when you use the Formfinity website, request a quote, send us files or place an order for a custom 3D printed item. By using this website or ordering from us, you agree to these terms. Please read them together with our Privacy Policy and Shipping & Returns policy.
About Formfinity
Formfinity is a small custom 3D printing business based in Adelaide, South Australia. We make collector displays, keychains, gifts, replacement parts and custom pieces using FDM 3D printing, and we sell through this website, Etsy, eBay and at local markets.
Quotes & Custom Orders
- Quotes are an estimate based on the information you provide. Unless stated otherwise, a quote is valid for 14 days and may change if the design, size, quantity, material or your requirements change.
- We confirm the design, materials, price and turnaround with you before printing begins. It is your responsibility to check and approve these details.
- Once production of a custom item has started, it may not be possible to change or cancel the order, as the item is made specifically for you.
- We may decline or pause any order at our discretion - for example, if a request is not technically feasible, unsafe, unlawful, or would infringe someone's rights.
Files You Supply & Intellectual Property
If you send us a model file (such as an STL), artwork, logo, photo or other reference for a custom job, you confirm and warrant that:
- You own the rights to that material, or you have permission from the rights holder to have it printed.
- Printing the item will not infringe any copyright, trademark, design right or other intellectual property, and will not breach any law.
You agree to indemnify Formfinity against any claims, losses or costs that arise from material you supply or from a custom request you ask us to produce. We may ask for proof of permission and may refuse any job we believe could infringe a third party's rights.
Some themed pieces are fan-made tributes created by request. Formfinity is an independent business and is not affiliated with, authorised by, sponsored by, or endorsed by any brand, franchise or rights holder referenced in a design. All third-party names, characters and trademarks remain the property of their respective owners.
Our Intellectual Property
The Formfinity name, logo, website content, photographs, product descriptions and our own original designs are owned by Formfinity (or used under licence). You may not copy, reproduce, resell or use them for commercial purposes without our written permission. Buying a printed item does not transfer ownership of any design or the right to reproduce it.
Pricing & Payment
- Prices are in Australian dollars (AUD) unless stated otherwise.
- Payment for orders on this website is processed securely by Square; orders on Etsy or eBay are paid through those platforms, and custom orders use a method agreed with you. Production of a custom order normally begins after payment or an agreed deposit is received.
- We try to keep all pricing accurate, but errors can occur. If an item is listed with an obviously incorrect price, we may cancel the order and offer a refund rather than fulfil it at the wrong price.
Product Nature & Suitability
Our items are individually 3D printed and are mainly intended for display, decorative, hobby or light functional use. Fine layer lines, small batch-to-batch variation and slight colour differences are normal. FDM printed parts also have small dimensional tolerances, so if you need a precise fit, tell us before ordering. Decorative pieces should be kept away from heat, direct sunlight, heavy load and rough handling. They are not certified for structural, safety-critical, food-contact, medical or high-heat use unless we have specifically confirmed this in writing.
Liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms limits those rights. Subject to that law, and to the maximum extent permitted, Formfinity is not liable for any indirect, incidental or consequential loss, and our total liability for any item is limited to the price you paid for it. We are not responsible for misuse of an item, normal wear, or carrier delays once an order has been dispatched.
Third-Party Platforms & Links
When you buy through Etsy or eBay, or follow links to other websites, those platforms have their own terms and policies that also apply to your use of them. We are not responsible for the content or practices of third-party sites.
International Customers
We are based in Australia and ship worldwide. If you order from outside Australia, you may have mandatory consumer-protection rights under the law of your own country - for example, buyers in the EU and UK have data-protection rights and a statutory right to cancel certain orders. Nothing in these terms removes rights that the law of your country says cannot be excluded, even though these terms are otherwise governed by South Australian law.
Import VAT, duties and customs charges on international orders are set by the destination country and are the buyer's responsibility. How this works, and the EU and UK right to cancel, are explained in our Shipping & Returns policy. How we handle your personal data, including EU, UK and US privacy rights, is set out in our Privacy Policy.
Changes & Governing Law
We may update these terms from time to time, and the current version will always appear on this page with the date above. These terms are governed by the laws of South Australia, and any dispute will be handled in the courts of South Australia.
